These Terms of Service ("Terms") form an agreement between JFC Group Pty Ltd trading as kinHome ("kinHome", "we", "us") and the organisation that registers for or uses the kinHome products ("you", "the operator"). By creating an account or using the products, you agree to these Terms. If you accept these Terms on behalf of an organisation, you confirm you have authority to bind it.
kinHome provides a connected suite of software products, which may include kinHome CRM, Journey, Connect and Manage, together with our website and related services (the "Services"). The specific products available to you depend on your subscription.
You are responsible for your account, for the users you invite, and for keeping credentials secure. You must ensure your users comply with these Terms, and you are responsible for configuring roles and permissions appropriately within your account.
You retain ownership of the data you and your users put into the Services ("Your Data"). You grant us a limited licence to host, process and display Your Data only as needed to provide the Services. You are responsible for Your Data and for ensuring you have the right to collect it and provide it to us, including obtaining any consents required from the individuals it relates to, such as your leads, buyers and residents.
You are responsible for complying with the laws that apply to your business, including the disclosure, contract, cooling-off and exit obligations relevant to your communities. kinHome is a tool to help you meet those obligations; it does not provide legal advice, and using it does not guarantee compliance.
You must not use the Services to break the law, infringe others' rights, send unlawful or unsolicited communications, upload malicious code, attempt to gain unauthorised access, or interfere with the Services. You must not resell or provide the Services to third parties except as permitted in your agreement.
Fees, billing frequency and the products included are set out in your order or agreement. Unless stated otherwise, fees are in Australian dollars and exclude GST. Late or unpaid fees may result in suspension. Indicative pricing on our website is provided for guidance only, is not an offer, and may change.
We own the Services, including all software, design and content other than Your Data. These Terms do not transfer any ownership in the Services to you. If you give us feedback, we may use it to improve the Services without obligation to you.
Each party may receive confidential information from the other. The receiving party will protect it with reasonable care and use it only as needed to perform under these Terms, except where disclosure is required by law.
We work to keep the Services available and reliable, but we do not guarantee uninterrupted access. We may update, improve or change the Services, and may add or remove features. We will not materially reduce the core functionality of a product you pay for without reasonable notice.
We provide the Services with reasonable care and skill. To the extent permitted by law, and except for guarantees that cannot be excluded under the Australian Consumer Law, the Services are provided "as is" and we disclaim other warranties. Nothing in these Terms excludes, restricts or modifies any right you have under the Australian Consumer Law that cannot be excluded.
To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential loss, or for loss of profits, revenue, goodwill or data. Our total liability arising out of or in connection with these Terms is limited to the fees you paid us in the twelve months before the event giving rise to the liability. Nothing in these Terms limits liability that cannot be limited by law.
You will indemnify us against claims arising from Your Data or from your use of the Services in breach of these Terms or the law, including claims by individuals whose information you processed without the necessary rights or consents.
These Terms apply while you use the Services or hold an account. Either party may terminate as set out in your agreement. We may suspend access where there is a serious breach, a security risk, or unpaid fees. On termination, your right to use the Services ends, and we will delete Your Data or make it available for export in line with your agreement and our Privacy Policy.
These Terms are governed by the laws of Queensland, Australia, and the parties submit to the courts of that jurisdiction.
If any part of these Terms is unenforceable, the rest continues to apply. We may assign these Terms in connection with a sale or restructure. These Terms, together with your order and our Privacy Policy, are the entire agreement between us about the Services.
